This Criminal Petition has been filed under Section 528 of

BNSS, by the petitioner/A3, seeking quashment of proceedings against

her in Crime No.281 of 2022 of Chintalapudi Police Station, Eluru District, registered for the offence punishable under Section 306 read with 34 IPC.

Today, when the matter is taken up for hearing, it is submitted by Ms.Boppudi Alekhya, learned counsel appearing on behalf of the petitioner that the A1 in the present case is the Branch Manager of DCCB Bank and the present petitioner i.e. A3 is Deputy General Manager. The A1 filed Criminal Petition No.8781 of 2022, seeking to quash the proceedings against him and, this Court allowed the said petition and quashed the proceedings in Crime No.281 of 2022 against A1, vide order dated 28.01.2025. Learned counsel would further submit that since the petitioner herein is similarly situated and the proceedings against her are liable to be quashed on the same grounds.

Learned Assistant Public Prosecutor also conceded that the subject matter of this Criminal Petition is squarely covered by the orders passed by this Court in Criminal Petition No.8781 of 2022, dated 28.01.2025.

A bare perusal of order dated 28.01.2025, in Criminal Petition No.8781 of 2022 would reveal that the case against the A1 was quashed observing that the A1 is Branch Manager of DCCB Bank, who has nothing to do with the affairs of the Society from which the deceased faced pressure to recollect loans and unable to face the pressure from the Society, the deceased committed suicide. It is also held that there no specific allegations against the A1 to the effect that he abetted the deceased to commit suicide and as such, no offence under Section 306

IPC was made out against the A1, resulting in quash of criminal proceedings against him.

Coming to the present case, the petitioner is the Deputy General Manager of DCCB Bank, Eluru who has nothing to do with the affairs of the society where the deceased faced pressure to recover loans and also no specific averments were made against the petitioner in the report lodged by the wife of the deceased, before the police. As rightly put by the learned counsel for the petitioner, the observations with regard to A1, mentioned in the order dated 28.01.2025 in Crl.P. No. 8781 of 2022, squarely apply to the present petitioner.

In view of the same, following the order passed by this Court in Criminal Petition No.8781 of 2022, dated 28.01.2025 and for the reasons mentioned therein, this Criminal Petition is allowed and the proceedings in Crime No.281 of 2022 of Chintalapudi Police Station, Eluru District, are hereby quashed in respect of the petitioner herein/A3.

As a sequel thereto, the miscellaneous petitions, if any, pending in this Criminal Petition, shall stand closed.
