The Court made the following Order:

This contempt case is filed against the respondents for willful disobedience of the orders passed by this Court in Writ Petition No.2053 of 2025, dated 30.01.2025. The operative portion of the said order is extracted hereunder:

“ 7. Taking into consideration the aforesaid submissions, this writ petition is disposed of and the respondents are directed not to threaten to demolish the petitioner’s house bearing D.No.22121-75/3, in an extent of 150 square yards in Sy.No.43/1, Dayalnagar, Pedagantyada, Visakhapatnam District, without following due process of law.

8. Accordingly, with the above direction, this writ petition is disposed of. There shall be no order as to costs. ”

Heard the learned counsel for the petitioner and the learned counsel for the respondents.

The 2^nd respondent has filed a detailed counter affidavit, wherein, it is stated that in pursuance of the orders passed by this Court dated 30.01.2025, eviction notice, as required under Section 7 of the Andhra Pradesh Land Encroachment Act, 1905, vide Rc.No.75/2025/SA, dated 10.03.2025, was issued, calling upon the petitioner to show cause as to why she should not be evicted from the Government land admeasuring 150 sq. yards in survey No.43/1, Pedagantyada Village, which is under her unauthorized occupation. For which, the petitioner has submitted her explanation on 24.03.2025 and thereafter, the 2^nd respondent passed orders vide RC.No.74/2025/SA, dated 25.03.2025, wherein, it is stated as under:

“ The Mandal Revenue Inspector, Pedagantyada and Village Revenue Officer concern are hereby directed to evict the above individual/writ petitioner from the land covered by their encroachment and take over the possession of the encroached land along with the material available therein the land if the encroacher is failed to hand over the encroached land voluntarily. The MRI is directed to evict the said encroachment with immediate effect and report compliance forthwith. ”

In view of the fact that, in pursuance of the orders passed by this Court dated 30.01.2025, the respondents have issued a eviction notice, as required under Section 7 of the Andhra Pradesh Land Encroachment Act, 1905, and after receipt of the explanation from the petitioner and having considered the same, have passed the final orders on 25.03.2025, this Court is of the opinion the respondents have complied with the orders passed by this Court and they have not committed any contempt.

In view of the same, the Contempt Case is closed. However, the petitioner is at liberty to challenge the proceedings issued the 2^nd respondent vide RC.No.74/2025/SA dated 25.03.2025. There shall be no order as to costs.

As a sequel, Interlocutory Applications pending, if any, shall stand closed.
