The present application has been filed under Section 11 of the Arbitration and Conciliation Act, 1996 (hereinafter referred to as “the Act”) for appointment of an Arbitrator to adjudicate upon the disputes arising out of and in connection with Work Orders, dated 01.04.2018 and 01.04.2019.

The applicant claims that the work in terms of the work orders supra was completed in its entirety. Invoices were raised of the same and while partial payments were made, there remained balance of approximately Rs.3,59,69,531/- due and payable still to the applicant. It is stated that repeated attempts to persuade the non-applicant to pay the balance having failed, the applicant served upon the respondent a notice, dated 08.06.2025, invoking the arbitration clause, which did not elicit any requisite response.

Be that as it may, disputes having arisen between the parties in regard to Work Orders, dated 01.04.2018 and 01.04.2019, the same are required to be resolved through the mechanism of arbitration.

Consequently, the present Arbitration Application is allowed. Justice Dr. V. R. K. Krupa Sagar, former Judge of the High Court of Andhra Pradesh, is appointed as an Arbitrator, who shall enter upon the reference and render the Award within the statutory period. The parties shall be free to file detailed claims and counter-claims, before the learned Arbitrator. The learned Arbitrator shall also be entitled to claim the fee in consultation with the parties.

Pending miscellaneous applications, if any, shall stand closed. No costs.
