Court may be pleased to issue a Writ of mandamus or any other appropriate writ order or direction declaring the action of respondents 3 and 4 in not considering the petitioner's representation^{Dt.25.07.2016and} 06.'06;2016 for payment of salaries as well as allowing the petitioner for discharging duties as Field Assistant without any valid^{reasonsandalso} the endorsement Dt.06.06.2016 issued by the 4th respondent is illegal and arbitrary and consequently set aside the endorsement Dt.06.06.2016 issued by the 4th respondent by allowing the petitioner to discharge duties as Field Assistant and paying salaries regularly including^arrears.

This writ petition is filed under Article 226 of the^{ConstitutionofIndia}

seeking the following relief;-

“...io issue a Writ of mandamus or any other appropriate writ order or direction declaring the action of respondents 3 and 4 in not considering the petitioner’s representation dated 25.07.2016 and 06.06.2016 for payment of salaries as well as allowing the petitioner for discharging duties as Field Assistant without any valid reasons and also the endorsement dated 06.06.2016 issued by the 4'^ respondent is illegal and arbitrary and consequently set aside the endorsement dated 06.06.2016 issued by the 4 th respondent by allowing the petitioner to discharge^{dutiesasFieldAssistant} and paying salaries regularly including arrears ...”

Today, when the matter came up for hearing, Mr.M.S.R.Chandra Murthy, learned Standing Counsel for the respondents, furnished a copy of the instructions from the Project Director, DWMA, Sri Sathya Sai District, dated 10.12.2014, wherein it is stated that, vide proceedings dated 12.10.2015 issued by the Project Director, DWMA, Anantapur, the petitioner was reinstated as Field Assistant to Poletipalli Gram Panchayat, Chennekottapalli Mandal. Accordingly, the petitioner joined duty as Field Assistant at Poletipalli Grampanchayat on 19.10.2015. Flowever, salaries were not paid to him for the months of January, February and March 2016 due to the^{non-renewalofhis} contract as his contract was discontinued due to non achievement of 75% of progress by the Gram Panchayat. Even though the petitioner^{wasreinstated} into service as Field Assistant on 19.10.2015, his salary was not paid for the above said months as per the directions of the C^missioner, RD, Andhra

Pradesh. But, however, the petitioner was paid salary for the months of October, November, December 2015 April, May 2016.

In View of the above ins.roc.ions, since the petitioner is being reinstated and continued in service as Field Assistant, this Coud is of the opinion that nothing survives in this writ petition for further adjudication.

Accordingly, this Writ Petition is closed. There shall be no order as to

costs.

Miscellaneous petitions pending if any, in this Petition shall stand

closed.
