23.06.1999. Thereafter, the petitioner reported for duty in the year 2003 and he was given posting in the SSR sub-division. Lateron,thepetitioneronce again applied for EOL from 19.07.2005 to 15.01.2006. Half-pay leave was sanctioned by the respondent and later he joined serviceon16.01.2006and worked upto May 2006. After that, the petitioner tookleaveinspells. Finally, after completing nearly 22years of qualified service,thepetitionersubmitteda representation dated 25.11.2006 requesting the TTDtopermithimtoretire voluntarily on medical grounds, by furnishing the medicalcertificates,whilethe respondent-TTD insisted that the petitioner shouldjointheservices.However, the petitioner repeatedly submitted representationsrequestingtoconsiderhis case on medical grounds. Finally after waiting for two moreyears,theTTD issued proceedings dated 06.11.2008 with retrospectiveeffect,statingthatthe voluntary resignation submitted by the petitioner was accepted with retrospective effect, though the petitioner never madehisresignation.Though the petitioner submitted several representations, nostepshasbeentakenby the respondent as such finally, the petitioner maderepresentationin2015to treat his resignation letter as a false and the periodofabsencemaybetreated as E.O.L.. But, in spite of the same as the respondentsdidnottakeany action, the present Writ Petition is filed.
