This Writ Petition is filed under Article 226 of the

Constitution of India seeking the following relief:

“ to issue an appropriate writ order or direction more particularly one in the nature of WRIT OF MANDAMUS declaring the action of the 4^th respondent in issuing orders in Rc. No.2163/2009-V4 (xxxiv) dated 30.9.2014 cancelling the permission accorded by 1^st Respondent for installation of additional Saw Band(Vertical Saw) in the Petitioners’ Saw Mill as illegal arbitrary and in violation of Principles of Natural Justice and hold that the petitioner is entitled to operate the Additional Saw Band (Vertical Saw) in accordance with the permission accorded by the 4^th respondent in Proceedings Rc. No.2163/2009-V4 dated 03012012 ..”

At the stage of admission, on 06.11.2014 this court passed interim order suspending the impugned order vide Rc. No.2163/2009-V4 (xxxiv) dated 30.9.2014 .

Learned Government Pleader for Forest appearing for the respondents, on instructions, submitted that in pursuance of the interim orders dated 06.11.2014 granted by this court, the petitioner is running the Saw Mill in accordance with the permission accorded by the 4^th respondent and his license is existed till 31.12.2023.

In view of the above submissions, since the license of the petitioner’s Saw Mill is existed till 31.12.2023, instead of keeping the Writ Petition pending, this Court feels it appropriate to dispose of the Writ Petition, giving liberty to the petitioner to make a fresh application to the respondents, upon receiving the same, the respondents are directed to consider same in accordance with law. There shall be no order as to costs.

As a sequel, miscellaneous applications pending, if any, shall also stand closed.
