This writ petition is filed to declare the inaction of the respondents in considering and disposing the objections, dated 27.07.2020^{and02.05.2024} submitted by the petitioner to the provisional seniority^{listsdated10.07.2020} and 25.04.2024 issued by respondents 1 and 2 respectively: and representation/appeal dated 05.07.2024 submitted by the petitioner to the final inter-se seniority list dated 02.07.2024, as illegal and arbitrary.

Petitioner, working as Multi-purpose Health Educational Officer (for short ‘MPHEO’) in Primary Health Centre, Burada, Vizianagaram District, submitted objections to the provisional seniority list and inter-se seniority list, issued by respondents 1 and 2 respectively, in the cadre of MPHEO. However, without disposing the objections, final inter-se seniority list in the cadre of MPHEO, was prepared and published vide Rc.No.14624/E5.B/2023 dated 02.07.2024, by the Director of Public Health and Family Welfare under EX.P21, for which the petitioner filed objections on 05.07.2024 under Ex.P22. The objections/appeal/representation made by the petitioner are forwarded to the Director of Public Health and Family Welfare, Andhra Pradesh through proper channel vide Rc.No.Spl/SA/2024 dated 05.07.2024 under Ex.P23. However, the same is not disposed of.

Heard learned counsel on either side. 4. At the hearing learned counsel for the petitioner, confined his arguments and urged to direct the authority to consider and pass appropriate orders on the objections/appeal/representation made by the petitioner. 5. Learned Assistant Government Pleader for Services, has not refuted the said submission of learned counsel for the petitioner. He submitted that if respondent No.2 forwards the objections to respondent No.3, respondent No.3 shall pass appropriate orders.

Given the above submissions. since the petitioner filed objections/appeal/representation regarding final interse seniority list in the cadre of MPHEO, which is forwarded to respondent No.2, this writ petition is disposed of at the admission stage, directing learned respondent No.2 to forward the petitioner’s objections/appeal/representation to respondent No.3 within two weeks from today, enabling respondent No.3 to pass appropriate

orders. On receipt of the objections/ appeal/representation, respondent No.3 shall consider the same and pass appropriate order, as per rules, as expeditiously as possible, within eight weeks from the date of receipt of the objections/appeal/representation. No costs.
