Petition under Article 226 of the Constitution of India praying that in the circumstances stated in the affidavit filed therewith, the High Court may be pleased to issue an appropriate Writ, Order or direction particularly in the nature of Writ of Mandamus declaring the impugned proceedingsdt. 11-7-07 in TMP T.A.No. 1757/99 passed by the second respondent Tribunal holding that the Miscellaneous petition as not maintainable on one hand and deciding the rnerits of the case on the other is illegal, arbitrary, unlawful, improper, unfair and the appointment of the Joint Commissioner of CT from the state government as departmental member on the bench of the Additional Bench of Sales Tax Appellate Tribunal at Visakhapatnam is improper and ultravires sub section (3) of Section of APVAT Act, 05 and consequently direct the first respondent government to appoint any officer of the State Government in the rank of Additional Commissioner of CT in terms of G.O.ms.No. 1707, dt. 1-10-05 and in the interregnum directing the Sales Tax'Appellate Tribunal namely the second respondent herein to defer hearing of the appeals required to be heard by a bench of the learned Chairman and another member in the rank of Additional Commissioner either from the State or Central Governments and grant such other relief as are deemed to be fit and proper in the circumstances of the case.
