The present Letters Patent Appeal has been preferred against the judgment and order dated 21.08.2023 passed in W.P. No.16359 of 2023.

It is stated that the observations made in the impugned judgment and order have the effect of granting a license to the Endowments Department to conduct an auction in regard to land over which the appellants claim a title. It is stated that the rights of the appellants in regard to the land, which is sought to be auctioned, is already a subject matter of consideration in W.P. No.19601 of 2014, which was filed by Smt Veena Kamalamma, who was the grandmother of the appellants herein. It is stated that the matter requires to be remanded to the learned Single Judge for enabling it to take up the same along with W.P. No.19601 of 2014, which is still pending.

Learned counsel for the respondents have no objection if the

matter is remanded in view of the statement so made.

Be that as it may, we set aside the judgment and order impugned and remand the matter to the learned Single Judge for consideration of the issue afresh along with W.P. No.19601 of 2014.

Registry to post W.P. No.16359 of 2023 along with W.P. No.19601 of 2014 on 27.02.2024 before the learned Single Judge having the roster.

Accordingly, the Writ Appeal is allowed. No order as to costs.

Pending miscellaneous applications, if any, shall stand closed.
