(a) The 1®' and the 2"^ claimants are the appellants andthe3 rd claimant is the brother of the deceased (M.Pavan Ganesh). On 30.10.2016, at about 09.30 A.M., when the deceased was riding a motor vehicle bearing registration No.AP 03 BX 2266 with a pillion rider (P.Somesekhar Reddy) on Srikalahasthi to Pichatur road, Thottambedu Mandal, Srikalahasthi Town, the motor cycle hit auto bearing registration No.AP 26 TB 6452. Immediately, the deceased and the pillion rider fell down and the deceased who received the head injurywasrushed to the Area Hospital, Srikalahasthi. He succumbed to the injurieson the same day. The claimants alleged that the accident was causedduetotherash and negligent driving of the auto driver. Based on the report of the pillion rider, a case in Crime No.82 of 2016 was registered in II Town Police Station, Srikalahasthi, against the driver of the auto under Section 304-A, 338 and 279 of IPC. Later, a charge sheet was filed against the driver of the auto under Section 304-A, 338, 279 IPC and Section 181(3), 134(a) & (b) r/w 187 of Motor Vehicle Act. The deceased was aged about 16 years and was hale and healthy. He was studying intermediate in Narayana Junior College, Renigunta. The deceased was brilliantstudentand he would have lived about at least 75 years and lookedafterwelfareofhis family members. The auto was insured by the 1®' respondent,who is its owner with the 2"^^ respondent.
