The Criminal Petition, under Section 438 Cr.P.C., is filed by the petitioners/A1 to A7 and A9 seeking to grant anticipatory bail in connection with Crime No.36 of 2024 of Machavaram Police Station, Palnadu District, for the offences punishable under Sections 143, 147, 148, 341, 427, 506 read with 149 IPC.

The case of the defacto complainant is that he is working as YSRCP Mandal Convenor in Machavaram Mandal. On 13.05.2024, at about 08.00 p.m., at Kotha Ganesunipadu Village, Machavaram Mandal, the accused and some other persons belonging to TDP, visited the houses of the YSRCP followers and attacked them with deadly weapons like sticks and rods. Due to fear of the incident, the YSRCP followers took shelter in Gangamma Talli Temple, Kotha Ganesunipadu Village. On 14.05.2024, at 03.00 p.m, Sri Kasu Mahesh Reddy, MLA of Gurazala Constituency, visited Kotha Ganesunipadu Village to know about the incident through the victims, at that time, the accused and some other persons formed into an unlawful assembly armed with deadly weapons like sticks, rods and stones and stopped the convoy vehicle and pelted stones, as a result, the convoy vehicle was damaged. The accused also threatened him with dire consequences.

Heard Sri Narra Srinivasa Rao, learned counsel for the petitioners, and learned Assistant Public Prosecutor appearing for the respondent.

The learned counsel for the petitioners submitted that there is no incriminating material found against the petitioners, who are the followers of TDP, and only with an eye sore that the TDP will gain majority in the General Elections, 2024, the said complaint is filed against the petitioners.

1. The learned Public Prosecutor has opposed the application.

Since all the offences alleged in the complaint are bailable in nature, the petitioners/accused Nos.1 to 7 and 9 are directed to surrender before the Court below and move an application for regular bail and on such

application, the Court below show consider and dispose of the said bail

application preferably on the same day subject to the pressure of other work.

1. With the above direction, the Criminal Petition is disposed of.

As a sequel, the miscellaneous applications, if any pending, shall stand
