ORDER:
The present Writ Petition came to be filed under Article 226 of the Constitution of India seeking the following relief:-
“…to issue a Writ of Mandamus or any other appropriate Writ, Order or Orders, Direction or Directions declaring the action of the 1st Respondent in issuing the proceedings No.1356/B1/2006 dated 15.10.2013 as illegal, unauthorised and in violation of natural justice and to issue a consequential direction to the 1st Respondent and his subordinates not to interfere with the construction of residential house by the petitioner in Plots No.1 and 2 Sy.No.46 Bestavaripeta village and mandal Prakasam District and pass…”
learned Government Pleader for Education produced a copy of written instructions vide Rc.No.A/453/2013, dated 18.12.2023, received from the Tahsildar, Bestavaripeta, Prakasam District, wherein it is stated that after field verification the Revenue Divisional Officer, Markapur submitted report to the Collector, Ongole vide Rc.B/28/2-16, dated 10.03.2016, stating that the authorities of Gram Panchayat are competent

to remove the objectionable constructions in the subject sites and the District Panchayat Officer, Prakasam District issued proceedings in Rc.No.1036/2015 (PTS) A2, dated 11.12.2015, directing the Panchayat Secretary, Bestavaripeta to stop the construction of Buildings in the subject plots, but however, thereafter, no action has been initiated either by the respondent Nos.4 & 5 or by the Panchayat Secretary, Bestavipeta and submits that the cause in the writ petition does not survive for further adjudication and prayed to close the same.
Miscellaneous petitions pending, if any, in this Writ Petition shall stand closed.
