Heard learned counsel for the petitioner. Also heard learned Assistant Government Pleader for Economically Weaker Sections Welfare Department and learned Assistant Government Pleader for Finance and Planning.

The present writ petition is filed seeking to declare the action of the respondents in not releasing the finance assistance of Rs.10,00,000/- to the daughter of the petitioner despite sanctioning funds by the Government as per

G.O.Rt.No.174, dated 07.12.2017 read with G.O.Ms.No.29, dated 27.08.2016, as illegal, arbitrary and unconstitutional.

Learned counsel for the petitioner made submissions inter alia with reference to the averments made in the affidavit more particularly para 6 of the affidavit. He submits that as per the Government Orders referred to supra, the petitioner is entitled for an amount of Rs.10,00,000/-. He submits that as per Clause 4(h) of G.O.Ms.No.29, dated 27.08.2016, the respondents have to release first installment after the candidate uploading the Immigration Card and the second installment has to be released after uploading of the results of the first semester. He submits that though the petitioner’s daughter uploaded the immigration card and results of two semesters, the respondents are not releasing the amount. In the said circumstances, the petitioner borrowed the amount from the known sources and sent the same to his daughter in abroad under the impression that the Government will release the financial assistance.

Be that as it may, he submits that despite making repeated requests to the respondents to release the financial assistance of Rs.10,00,000/- but the same has not been paid to

the petitioner and in those circumstances, the petitioner is constrained to file the present writ petition.

While this Court see justification in the submissions made by the learned counsel for the petitioner, however, deems it not necessary to deal with the matter in detail. As seen from the written instructions, dated 10.11.2023 placed for perusal of this Court, it would appear that the verification of the documents submitted by the petitioner’s daughter was completed and as per the report of the Vigilance Enforcement Department, she is eligible for financial assistance. However, the delay in releasing financial assistance in the matters of this nature, is not appreciable.

Considering the submissions made by the learned Assistant Government Pleader with reference to the said instructions, that the amount of Rs.10,00,000/- would be released within a period of three months, this Court deems it appropriate to dispose of the writ petition with a direction to the respondents to release the said amount as expeditiously as possible, within a period of two months, from the date of receipt of a copy of this order.
