“to issue a writ, order or direction more particularly one in the nature of WRIT OF MANDAMUS declaring the action of Respondents in not preventing the illegal and unauthorized mining activity being carried out by respondents 13 to 15 in large scale and excavation of Gravel in the land of the Hill Area and surrounding lands covered by Sy.No.358/1 of Venkata Krishnapuram Revenue Village in Dwaraka Tirumala Mandal of Eluru District, by deploying heavy excavators and transporting the material using Trucks, Tractors and other heavy vehicles thereby causing damage and substantial loss to the Horticulture Crops, Nurseries, live stock and to the Government Exchequer besides adversely effecting ecological balance and destroying natural resources without any permission to do so, despite the representation dt.07.07.2022 submitted by the petitioner and other villagers on behalf of farmers of the Village as illegal, irregular, irrational and violative of provisions of Mining Regulation Act and rules and regulations framed there under Andhra Pradesh Panchayat Raj Act, 1994; Andhra Pradesh (Andhra Area) Public Health Act, 1939; Environment (Protection) Act, 1986 and offends Articles 14 and 21 of Constitution of India and consequently direct the respondents 1 to 12 to prevent respondents 13 to 15 and their henchmen from carrying out illegal and unauthorized mining activity and excavation of Gravel from the aforesaid lands by sizing the offending vehicles and recovering mining seigniorage with penalty and pass such other order or order(s)…..”
