ORDER:

The vehicle of the petitioner bearing No.KA 07 M 9867 was seized on 06.01.2023 in Crime No.4/2023, on the file of the 4^th respondent, on the ground that the said vehicle was being used for transport of illegal liquor.

The petitioner had thereupon, approached the 4^th respondent for release of the vehicle. He was informed that the vehicle had been handed over to the 3^rd respondent.

Aggrieved by the said direction given by the 4^th respondent, the petitioner has approached this Court with a direction to the 4^th respondent to release the said vehicle.

The learned Government Pleader for Excise, on instructions, submitted that the vehicle is presently in the custody of the 6^th respondent and the petitioner is required to make an application to the 6^th respondent for release of his vehicle. Thereupon, a decision would have to be taken by the 6^th respondent in this regard.

In similar circumstances, this Court has been issuing directions to the concerned respondent authorities for

considering such applications for release of vehicles.

Consequently, this Writ Petition is disposed of with the

following directions:

1. It is open to the petitioner to submit a representation to the 6^th respondent for release of his vehicle.

¶13

1. Upon such representation being received, the 6^th respondent shall consider the said application for release of the vehicle into the interim custody of the petitioner, pending confiscation of proceedings, by taking immovable property security equivalent to the value of the said vehicle of the petitioner or such other security which is acceptable to both the 6^th respondent and the petitioner.

1. The 6^th respondent shall pass orders on the application of the petitioner within one (01) week of receipt of the application from the petitioner.

¶15

There shall be no order as to costs.

¶16

Miscellaneous petitions, pending if any, in this Writ Petition shall stand closed.
