01 Heard the learned counsel on both sides.

The petitioner is challenging the order passed by the Appellate Authority under A.P.Shops and Establishments Act, 1988, Eluru in A.P.S.A.No.08 of 2003 dated 22.09.2003. Appellate authority has to decide the order dated 31.10.2003 passed by the Assistant Commissioner of Labour, Vijayawada. The order in appeal dated 22.09.2003 has directed the Writ petitioner to pay a sum of Rs.5,500/- towards compensation to the 1^st respondent. This is the case of the petitioner that the 1^st respondent absconded from duties from 1.7.1998 without any reason. It is also stated that the 1^st respondent collected the salary for the month of June, 1998 on 04.07.1998 and informed that he would be resigning from service with effect from 01.07.1998. It is case of the petitioner that on account of the first respondent’s own conduct, the first respondent refrained from continuing as a workman with the petitioner Establishment. On the other hand the first respondent has challenged the Act of termination of the petitioner before the

Competent Authority and ultimately by order dated 22.09.2003, the appellate authority/Shops and Establishment Act, 1988, Eluru directed the respondent therein and the petitioner herein to pay a sum of Rs.5,500/- towards compensation. As seen from the submissions and also from the record available, no grounds are made out interfering the order passed by the Second respondent.

The Writ Petition is dismissed. No order as to costs.

As a sequel, pending miscellaneous petitions, if any,

shall stand closed.
