Petition under Article 226 of the Constitution of India praying that in the circumstances stated in the affidavit filed therewith, the High Court may be pleased to issue direction or order or writ particularly one in the nature of writ of Mandamus to declare that the action of the respondents No. 2 and 3 in having orally informed the petitioner on 19-08-2023 that the petitioner would not be perniitted to participate in the second phase of counseling being held till the end of September 2023 for admission into MBBS course for the academic year 202324 on the ground that petitioner did not produce her 10*” class original pass certificate for verification as arbitrary, illegal and violative of Article 14 of the Constitution of India and consequently direct the respondents No. 2 and 3 and permit the petitioner to participate in the ongoing second phase of counseling being held till the end of September 2023 for admission into MBBS course for the academic year 2023-24 on the petitioner production of Xerox copy of the original 10th class pass certificate.

The controversy in the present petition revolves round a very narrow compass. The petitioner is- desirous of participating in the counselling process for admission in the MBBS Course, which is being conducted by the respondent - Dr.YSR University of Health Sciences, Vijayawada.

Learned Standing Counsel for the respondent - Dr. YSR University of Health Sciences states that the petitioner has not made any formal application for permitting her to participate in the counselling process. It is stated that in case the petitioner applies in accordance with the terms and conditions of the brochure, she would be accorded consideration.

Be that as it may, we direct the 8“* respondent - Dr. YSR University of Health Sciences to permit the petitioner to participate in the counselling process on her submitting a formal application in this regard within two days from today and on her furnishing the Xerox copy ofthe relevant certificates.

The Writ Petition is, accordingly, disposed of. No costs.

Pending miscellaneous applications, if any, shall stand closed.
