ORDER:
This Writ Petition is filed by the petitioner, under Article 226
of the Constitution of India, seeking the following relief:
“….to issue a writ of mandamus or any other appropriate writ or direction declaring the action of the Respondents in withholding the payment of amount of Rs.36,46,820/- even after finalizing the bills payable to the petitioner in relation to the works i.e., “Construction of BT Road from Pedavegi Center to Palm Oil Factory in Pedavegi (V) of Pedavegi Mandal, Bit 1, Bit 2, Bit 3, Bit 4” vide agreement dt.27.12.2022, is questioned, as the same is illegal, arbitrary and consequently direct the respondents to consider for payment amount of Rs.36,46,820/with interest @ 24 % per annum for the delayed amount to the petitioner in respect of execution of abovementioned work forthwith and pass such other or further order…..”

respondent authorities are ready and willing to pay the amount of Rs.36,04,354/- and sought three months time for payment.
“The respondent authorities are directed to release an
amount of Rs.36,04,354/- (Rupees Thirty Six Lakhs Four Thousand Three Hundred and Fifty Four only) to the petitioner at the earliest, and at any rate, within a period of three (3) months from the date of receipt of a copy of this order. It would be open to the petitioner to agitate its claim for interest, if any, payable by the respondents, if it is so advised, in an appropriate forum.”
There shall be no order as to costs.
As a sequel, miscellaneous petitions pending, if any, shall stand closed.
