Petition under Article 226 of the Constitution of India is filed praying that in the circumstances stated in the affidavit filed therewith, the High Court may be pleased to issue an appropriate writ, order or direction, more particularly one in the nature of Writ of Mandamus declaring Tender Condition No.4(ix) and 4(x) of the Tender Notice No.Movt/48/Stage-ll/2023-25/CSC Dt.26.6.2023 issued by 3rd Respondent, which are insisting only the existing Stage-ll contractors to submit (i) Satisfactory Certificate from the Joint Collectors and EOEDs of the concerned districts and (ii) Clearance Certificate from the Vigilance and Enforcement Authorities respectively, as illegal, unjust, arbitrary, discriminatory, irrational, without jurisdiction, suffers from colourable exercise of power and in violation of Articles 14, 19 and 21 of the Constitution of India and consequently set aside the impugned Condition Nos.4(ix) and 4(x) of the Tender Notice Dt.26.06.2023.

Petition under Section 151 CPC is filed praying that in the circumstances stated in the affidavit filed in support of the writ petition, the High Court may be pleased to direct the Respondents to permit the Petitioner to participate in the Stage-ll tender process for Jangareddygudem MLS Point of Eluru District by suspending the impugned Tender Condition No.4(ix) and 4(x) of the Tender Notice No.Movt/48/Stage-ll/2023-25/CSC Dt.26.6.2023 issued by 3rd Respondent, pending disposal of the above writ petition.
