ORDER:

The present writ petition is filed under Article 226 of the Constitution of India seeking following relief:

“to issue any Writ Order or Direction more particularly one in the nature of Writ of Mandamus declaring the impugned Proceedings Rc.No.Spl/DPHFW/E4/2022, dated 27.9.2022 issued by the 3^rd respondent and also the proceedings vide Rc.No.2570/E2/2022 dated.4.01.2023 by the 7^th respondent issuing provisional seniority list for counselling and transfer of MPHA(male) to the post of ANM, Village / Ward Secretariats which is contrary to the Memo No.8259/C1/2010-1, dated 14.06.2010 is illegal, arbitrary, unjust and violation of Articles 14 19 and 21 of the Constitution of India and contrary to the rules and to set aside the same and consequently direct the respondents to not to transfer and post the petitioners for the post of ANM in village/ward secretariats and to continue the petitioners same as MPHA (Male) and pass such other order or orders..”

Heard learned counsel for the petitioners and learned counsel for the respondents.

Learned counsel for petitioners straight away takes this Court through the order, dated 23.12.2022, passed by this Court in W.P.Nos.35750 of 2022 and batch as the facts and circumstances of this case are similar to that of this case.

Learned Government Pleader does not refute the submission that the said order covers the matter before this Court in this writ petition.

Relevant paragraph of the order passed in W.P.Nos.35750 of

2022 and batch is extracted hereunder:

“ 6. However, Respondents shall consider the request of the Writ Petitioners on the same grounds as considered for their counterparts in regular service in terms of guidelines in G.O.Ms.No.45 dated 24.06.2019 as it is incumbent on the State to extend similar conditions to the present Writ Petitioners also.

7. In view of these directions, the Official Respondents may consider the postings of the Writ Petitioners as per the mapping indicated in the proceedings of District Medical & Health Officer, Eluru District (At page 18 of the common Counter).”

Following the said order, this Writ Petition is disposed of, directing the respondents to consider the request of the petitioners on the same grounds as considered for their counterparts in regular service in terms of guide lines in G.O.Ms.No.45 dated 24.06.2019 as it is incumbent on the state to extend similar conditions to the present petitioners also.

With the above direction, the Writ Petition is disposed of. There shall be no order as to costs.

As a sequel miscellaneous application, pending, if any, shall also stand closed.
