ORDER:

This writ petition is filed by the petitioners under Article 226 of the Constitution of India for the following reliefs:

“...to issue an appropriate Writ or any other Order or Direction, more particularly one in the nature of Writ of Mandamus, declaring the action of the respondents in not considering the petitioner’s representations dated 12.04.2023 in view of G.O.Ms.No.01 Department of Gram Volunteers / Ward Volunteers & Village Secretariats / Ward Secretariats dated 04.01.2023 seeking to re-designation as Village Secretariat (Welfare & Education Assistant), as illegal and arbitrary and in violation of principles of natural justice and in contravention of Articles 14, 16 and 21 of the Constitution of India and also contrary to the Service rules, and consequently direct the Respondents to re-designation as Village Secretariat with all benefits forthwith and to pass such other or further orders...”

When the matter is taken up for hearing, learned counsel for

the petitioners mainly submits that the respondents may be directed to dispose of the representation dated 12.04.2023 filed by the petitioner seeking for conversion of Ward Secretary to Village

Secretary, for which learned counsel for the respondents has expressed no objection.

Having regard to the submissions made by both the learned counsels and in the facts and circumstances of the case, without going into the merits of the case, the Writ Petition is disposed of with a direction to Respondent No.5 to consider the representation of the petitioner dated 12.04.2023, in view of G.O.Ms.No.01, dated 04.01.2023 and pass orders within a period of four (04) weeks from the date of receipt of a copy of this order, after providing an opportunity of hearing to the petitioner. No order as to costs.

As a sequel thereto, interlocutory applications, if any pending, shall stand closed.
