ORDER:

The present Writ Petition is filed under Article 226 of the Constitution of India seeking the following relief:-

“….to issue an appropriate Writ, Order or Direction more particularly a in the nature of Mandamus declaring the action of the Respondent Nos. 2 and 3 in trying to interfere with the Petitioner properties i.e., (1) Ac.0.03 Cents in Patta No. 72 in Sy. No. 181/2 with boundaries:- East: Road, South: Land belongs to Petitioner, West: Sy. No. 72 Drinking Water Tank, Patta Land of late Yarubandi Venkatratnam; (2) North: Sy. No. 181 Patta land of Makarju Venkata Premulla Raju, East:Village Road, South: Kunavaram Canal No. 182, West:Sy.No. 72: in Sy. No. 181/1 an extent of Ac.0.06 cents for Choultry, situated in Kunavaram Village of Uppalaguptam Mandal, East Godavari District, without following due process of law, as illegal, discrimination and violative of principles of natural justice and to pass…”

By an Order, dated 07.03.2011, this Court directed the Respondents not to interfere with the Petitioner’s land admeasuring Ac.0.03 Cents and Ac.0.06 Cents, without following due process of law. Subsequently, on 17.03.2011, the interim order granted earlier is extended until further orders.

No counter is filed till date or any application to vacate the interim Order passed by this Court on 07.03.2011.

Today, when the matter is taken up for hearing, Sri.G.Simhadri, learned Counsel appearing for the Petitioner submits that, the Writ Petition may be disposed of making the Interim Order, dated 07.03.2011, as final order.

The same is not seriously opposed by the Government Pleader for Panchayat Raj or the Government Pleader for Revenue.

Having regard to the above, it may not be necessary for us to go into the matter in detail. Thus, the present Writ Petition is disposed of , making the interim order as final order, directing the Respondents not to interfere with the property in dispute, except in accordance with the procedure established by law. No order as to costs.

As a sequel, interlocutory applications, if any, pending shall stand closed.
