WRIT PETITION No.5288 OF 2022

ORDER:

The petitioner seeks writ of mandamus declaring the action of the 2^nd respondent in not deleting the petitioner’s land admeasuring an extent of Acres 5.49 cents in Survey No.74 and Acres 2.58 cents in Survey No.73 of Nandanuru Village, Gangadhara Nellore Mandal, Chittoor District, from the list of prohibited properties under Section 22-A(1)(c) of the Registration Act, 1908, as illegal, arbitrary and for a consequential direction.

Heard learned counsel for the petitioner, Sri V.Ramesh and learned Assistant Government Pleaders for Revenue-cum-Stamps and Registration and Endowments representing on behalf of the respondents and with their consent, this writ petition is disposed of at the admission stage.

As can be seen from the material papers filed along with writ petition, the petitioner has already made an online application No.TTA012100080330, dated 22.12.2021, to the 2^nd respondent under Sec.22-A(1)(c) of the Registration Act, 1908 for considering his case and for deletion of the aforesaid properties from the list of prohibited properties under Section 22-A of the Registration Act and the said application is pending for consideration.

In that view of the matter, this writ petition is disposed of directing the 2^nd respondent to consider the application of the

petitioner and after affording a personal hearing to the petitioner, pass an appropriate order in accordance with the governing law and rules expeditiously but not later than eight weeks from the date of receipt of a copy of this order and communicate to the petitioner. No costs.

As a sequel miscellaneous petitions pending for consideration, if any, shall stand closed.
