ORDER:

The present writ petition came to be filed under Article 226

¶5

of the Constitution of India seeking the following relief:

“…to issue a writ, order or direction more particularly one in the nature of Writ of Mandamus declaring the action of the 2^nd respondent herein taking hectic steps to disposes the petitioner herein from the land admeasuring Ac.5.75 Cents in S.No.225 situated at Pedarajupalem Village, C.S.Puram Mandal, Prakasam District, A.P., at the behest of the respondent 3 & 4 herein as biased arbitrary, illegal and capricious and consequently direct the respondents herein not to interfere with the possession of the petitioner herein in the aforesaid as long as the D/o.-Form Patta vide F Dis/105/1401 dated 19-06-1992 is subsisting in his favour….”

Today, when the matter came up for hearing, learned Government Pleader for Revenue has produced a copy of the instructions of the Tahsildar, C.S. Puram, vide Rc.No.DT/100/2022, dated 18.12.2022 wherein it is stated that after conducting proper enquiry the Joint Collector, Ongole issued orders vide R.P.No.D.Dis./D6/e-23439/2017, dated 09.11.2022, duly cancelling entries in R.O.R record i.e., 1A, 1B Registers, Webland and also cancelled the Pattadar Pass Books and Title Deeds previously issued to 311 individuals belonging to

Pedarajupalem and Nalajanampadu villages. It is also stated that the original assignee of the land in Sy.No.225 to an extent of Ac.5.00 each were Koduru Murali Krishna S/o.Obul Raju and Nandimandalm Venkata Subbamma W/o. Hussain Raju. It is also stated that the present Writ Petitioner got the subject land by way of various means from the original assignee, thus attracted principles under Prohibition of Transfer Act and his entries in Webland, Pattadar Pass Books were cancelled as per the above orders of the Joint Collector, Ongole.

In view of the instructions given by the 2^nd Respondent/Tahsildar, C.S. Puram, this court feels it appropriate to close the Writ Petition, leaving it open to the petitioner to challenge the proceedings of the Joint Collector dated 09.11.2022, if at all he is aggrieved by the same and hence no orders need to be passed.

Accordingly, this writ petition is closed. There shall be no order as to costs.

As a sequel thereto, miscellaneous petitions, if any, shall stand closed.
