This writ petition is filed under Article 226 of the Constitution of India, seeking to declare the action of the respondents in keeping the petitioner’s agricultural land admeasuring Ac.4.70cents in Survey no.2150 of Vontimitta revenue village and mandal, YSR Kadapa District in the prohibitory list under the category of “Dotted lands” vide gazette notification in G.O.Ms.No.200 Revenue (ASSN.I) Department dated 05.5.2016 in the annexure at Sl.No.224488, as illegal, arbitrary and consequently set aside the aforesaid gazette notification in so far as aforesaid petitioner land is concerned.

During the course of hearing, learned counsel for the petitioner would submit that the subject matter of the writ petition is squarely covered by the order of this Court dated 14.12.2020 passed in W.P.No.13896 of 2020.

Learned Government Pleader did not oppose the said submission.

Learned Assistant Government Pleader appearing for the respondents categorically stated that the District Collector i.e. 2^nd respondent herein, is the competent authority to consider the case of the petitioner, either for deletion or for inclusion of the property in the list published under section 22-A of the Registration Act, 1908 and readily agreed to consider the application, if submitted afresh, by the petitioner and dispose of the same, within a reasonable time as per Rules.

Having regard to the facts and circumstances of the case and considering the submissions and in the light of the above order of this

Court, this Writ Petition is disposed of, at the stage of admission, with the consent of both the counsel, directing the petitioner to make a fresh application/representation before the District Collector/2^nd respondent herein, bringing all the facts with relevant records, within one (01) month from the date of receipt of a copy of this order, on such application/representation, the 2^nd respondent shall consider the same, taking all relevant records into consideration and pass appropriate orders as per Rules within two (02) months from the date of receipt of application/representation from the petitioner. No costs.

As a sequel, miscellaneous applications pending, if any, shall also stand closed.
