This petition is filed under Article 226 of the Constitution of India, seeking the following relief:-

“….to issue writ of mandamus or any other appropriate writ order or orders declaring the action of the respondent No. 5 in directing the Respondent No.3 for registration of the land in Sy.No.114 for an extent of Ac.0-05 cents situated at Kagitha Village, Nakkapalli Mandal, Visakhapatnam District which is illegally arbtiray and violative of principles of natural justice and consequently to direct the Respondent No.5 not to interfere with the peaceful possession of the property for an extent of 15 cents in Sy.No.SY.No.113/2 situated at Kagitha Village, Nakkapally Mandal and Visakhapatnam District and to pass such other relief or reliefs…”

Though the petitioner made several allegations against the respondents, during hearing, learned counsel for the petitioner restricts his prayer to direct the respondent authorities not to interfere with the petitioner’s peaceful possession and enjoyment without following due process of law and without going into the merits of the case and the same was agreed by the learned Government Pleader for Revenue.

In view of the above submission of both the learned

counsels and without going into the merits of the case, this Writ Petition is disposed of by directing the respondent authorities not to interfere with the peaceful possession and enjoyment of the petitioner over the subject land i.e. land in Sy.No.114 for an extent of Ac.0-05 cents situated at Kagitha Village, Nakkapalli Mandal, Visakhapatnam District, except by following the due process. There shall be no order as to costs.

As a sequel, Interlocutory Applications pending, if any, in this Writ Petition, shall stand closed.
