ORDER:-

This writ petition under Article 226 of the Constitution of India is filed seeking to declare the Encroachment Notice dated 28.04.2022 issued to the petitioner by the 2^nd respondent as contrary to law, illegal, arbitrary, vague against the principles of natural justice and consequently to direct the respondents and their staff/subordinates not to interfere with the property of the petitioner i.e., Plot No.7 in Sy. No. 80-1A of Tamarada Village, Kirlampudi Mandal, East Godavari District.

As per the averments made in the writ petition, the respondents granted house patta in respect of the property in Sy. No. 80/1A admeasuring an extent of Ac.0.02cents of Tamarada village, Kirlampudi Mandal, East Godavari District. The petitioner got constructed a house in the said land. Now without cancelling the said patta and without assigning any reasons, the respondents are interfering with the possession of the petitioner. Hence, the present writ petition.

Though several allegations made against the respondents, the learned counsel for the petitioner limited his request to direct the respondents not to dispossess the petitioner from the subject property, except by due process of law.

Learned Assistant Government Pleader submitted that the respondents will follow due process of law before evicting the petitioner. 5. In view of the facts and circumstances of the case and on a perusal of the material placed on record, this writ petition is disposed of directing the respondents not to interfere and dispossess the petitioner from the subject property without following due process of law.

With the above directions, this writ petition is disposed of. No costs.

As a sequel thereto, interlocutory applications, if any, shall also
