After arguing for some time, the learned counsel for the appellant/writ petitioner submits that the appellant is a beneficiary of the Award dated 31.10.2002 passed by the Industrial Tribunal-cum-Labour Court, Visakhapatnam in I.T.I.D.(C) No.54 of 2001 and as the said Award was not implemented in its true letter and spirit, the writ petition was preferred. He submits that filing of writ petition was not an appropriate remedy and the appellant/writ petitioner feels that he should have approached the Industrial Tribunal-cum-Labour Court. He prays that the

appellant/writ petitioner may be permitted to withdraw the writ petition as well as this writ appeal reserving liberty to approach the Labour Court.
