Both the learned counsel are present.
Learned counsel for the appellant submits that the litigation was settled out of Court. Therefore this Second Appeal need not be adjudicated. Learned counsel is requested to file a memo to that effect during the course of the day. Learned counsel for the respondent agrees with the learned counsel for the appellant. In these circumstances, the Second Appeal is dismissed as settled out of court.
