This Civil Revision Petition is filed by the petitioner under Section 115 of Civil Procedure Code (in short CPC) against the Orders passed by learned Principal Senior Civil Judge, Nellore, in E.A.No.119 of 2015 E.P.No.178 of 2011 in O.S.No.80 of 1991, dated 17.04.2015 wherein and whereby Court below directed Court Ameen executing delivery warrant with the assistance of Mandal Surveyor in pursuance of the delivery orders passed by same Court in E.P.No.178 of 2011, which is also subject to challenge in C.R.P.No.1593 of 2015. This Court after elaborately discussing the facts and circumstances of the case set aside the delivery order passed by Court below in E.P.No.178 of 2011 passed orders in C.R.P.No.1593 of 2015. When delivery of E.P. schedule property itself is set aside by this Court question of directing the Court Ameen to deliver the property with the assistance of Mandal Surveyor does not arise. The orders passed by the Court below directing the Field Assistant to deliver schedule properties to the respondents with the assistance of Mandal Surveyor are hereby set aside.

In the result, the Civil Revision Petition is allowed. The orders passed by Principal Senior Civil Judge, Nellore, in E.A.No.119 of 2015 in

E.P.No.178 of 2011 in O.S.No.80 of 1991 are hereby set aside. No order as to costs.

Consequently, miscellaneous petitions, if any, pending shall stand closed.

The interim stay if any granted is stand vacated.
