ORDER:

The petitioner, who is accused No.1 in Crime No.13 of 2022 registered with the Saravakota Police Station, for an offence under Section 304-II I.P.C is personally present.

The de facto complaint is also personally present.

Both of them have been identified by their respective

counsel.

¶8

The petitioner and the de facto complainant/2^nd respondent have appeared before this Court with the intention of compromising the complaint filed against the petitioner by getting the same quashed by this Court exercising power under Section 482 of Cr.P.C.

The de facto complainant says that the accident, in which his wife and son had passed away, had occurred partly on account of the de facto complainant himself, and as such he is not interested in going forward with the compliant. He further submits that he is convinced that the negligence complained of earlier, against the petitioner, was not of such a serious nature

that the demise of his wife and son can be put on the petitioner alone.

In view of the above submissions, it would be

appropriate for this Court to give a quietus to the entire affair.

¶14

Accordingly, both the applications and the Criminal Petition are allowed and the proceedings in Crime No.13 of 2022 before the Saravakota Police Station, Srikakulam District against the petitioner is quashed.

As a sequel, pending miscellaneous petitions, if any, shall stand closed.
