Heard learned counsel for the petitioners and the learned Assistant Government Pleader for Revenue representing the sole respondent.

1. The Contempt Case is filed alleging disobedience of the order dated 28.06.2021 passed by this Court in W.P.No.5727 of 2021, wherein it was inter alia observed that if the respondent intends to take possession of the properties of the petitioner, they shall follow due process of Law.

In the Contempt Case, it was alleged that the respondent, at the behest of ruling party followers, was interfering with the petitioners’ construction activities and the same constitutes Contempt of the Court. Initially, a reply affidavit dated 22.06.2022 was filed. However, in the light of the orders dated 13.10.2022, the respondent filed another affidavit on 21.10.2022. Though the respondent adverted to the various averments made in the affidavit filed in support of the Contempt Case, the crucial aspect that is with regard to the alleged interference by the respondent with the subject matter property has not been adverted to. However, another affidavit has been filed on 22.11.2022, wherein it was inter alia stated as follows:-
