Questioning the inaction of the 2^nd respondent in passing orders on the stay application filed by the petitioner, on 30.10.2021, along with the appeal preferred against the order passed by the 3^rd respondent dated 25.10.2021, as being illegal and arbitrary, the present writ petition is filed.

Learned counsel for the petitioner submits that by the order dated 25.10.2021 the 3^rd respondent has suspended the fair price shop authorisation of the petitioner in respect of fair price shop No.0813031 of Tripurasundaripuram village of Darsi Mandal, without considering the explanation submitted by the petitioner to the inspecting authorities during the course of inspection that the excess stock available in the fair price shop belong to the family members of the petitioner and without assigning any valid reasons for minor variations, which is illegal. Against the said order, the petitioner has preferred appeal before the 2^nd respondent along with stay application. But the 2^nd respondent is not passing orders on the stay application. If the orders of the 3^rd respondent are implemented the petitioner’s fair price shop would be entrusted to third party and the purpose of filing of the appeal would be defeated.

Learned Assistant Government Pleader submits that the appeal along with the stay application was filed only on 30.10.2021 and without waiting for reasonable time the petitioner rushed to this Court and that the appeal would be disposed of by the 2^nd respondent within a reasonable time as per law.

Having regard to the facts and circumstances of the case, submissions of the learned counsel and on perusal of the material record, this Court, in the

interests of justice, felt it appropriate to dispose of the writ petition directing the 2^nd respondent to dispose of the appeal said to have been filed by the petitioner on 30.10.2021 against the order dated 25.10.2021 passed by the 3^rd respondent, as per law, as expeditiously as possible and communicate the same to the petitioner. During the pendency of the appeal, the operation of the suspension order dated 25.10.2021 is suspended and the respondents are directed to continue the petitioner as fair price shop dealer of FP shop No.0813031, Tripurasundaripuram Village, Darsi Mandal, and supply essential commodities to the petitioner to distribute the same to the cardholders.

With the above directions, the Writ Petition is disposed of. No order as to costs.

Pending Miscellaneous Petitions shall stand closed.
