Later, the Government issued G.O.Ms.No.616 Revenue (Assgn.IV) Department, dated 02.06.2011 and assailing the said G.O., the vendor filed W.P.No.15601 of 2011 and the same was allowed on 12.09.2017 setting aside the said G.O. While the matter stood thus, the petitioner with an intention to alienate the property to third parties, he approached the 6th respondent to furnish market value certificate, but the 6th respondent refused to furnish the same on the ground that the subject property is included in the list of prohibited property maintained under Section 22-A (1) (e) of the Registration Act vide G.O.Ms.No.215, dated 13.05.2016. Even if the subject land is an assigned land, initially, there were number of transactions prior to 1954. While assigning the land, no condition was incorporated prohibiting the alienations. Therefore, the inclusion of the petitioner’s landed property in the prohibited property list is illegal, arbitrary. Moreover, the Government issued G.O.Ms.No.575, dated 16.11.2018 for deletion of lands assigned prior to 1954, from the purview of Section 22 A (1) (e) of Registration Act. However, no steps were taken for deletion of the property from the list of prohibited properties and the 6th respondent is refusing to give market value certificate on the ground that the subject land is included in the prohibited list maintained under Section 22-A (1) (e) of Registration Act. Hence, the present writ petition is filed.
