ORDER:
This writ petition is filed questioning the action of respondents 2 and 3 in not initiating action against 4th respondent for digging fish tank in an extent of Ac.3-16 cents in Sy.Nos.439/2 and 439/3 of Padanindrakolanu village of Nidamarru Mandal, West Godavari District, as illegal and arbitrary.
“Pending further orders, the respondent authorities shall ensure compliance with the terms of G.O.Ms.No.7, Animal Husbandry, Dairy Development and Fisheries (FISH.II) Department, dated 16.03.2013 and more particularly Clause 7.29 and 7.30 thereof. The respondent authorities shall verify as to whether the application of the 4th respondent is pending consideration and whether any provisional registration has been issued to him enabling him to undertake digging operations and take necessary action in the matter accordingly.”

“As per the above matter, I submit that, the above mentioned land is old Fish Tank which was dug long back i.e. above 18 years, the owner of the land has applied for permission for regularization of fish tank under the request for Existing Fresh Water Aquaculture Farm and got Existing Fresh Water Aquaculture Farm Permission from competent authority under G.O.Ms.No.7 Animal Husbandry, Dairy Development and Fisheries (FISH.II) Department dated 16.03.2013. At present there is no further development activities are going on in the said survey numbers land.
It is therefore prayed that the Hon’ble High Court may be pleased to dismiss W.P.No.19357 of 2013 and pass

such other order or orders may deem fit and proper circumstances of the case.”
