After hearing both the learned counsel it transpires that the reply has been given by the petitioner on 11.08.2021. The first hearing was fixed on 08.09.2021, but the petitioner did not appear. Thereafter, a notice dated 17.09.2021 was issued fixing the enquiry on 25.09.2021. Both the learned counsel agreed that as progress is being made the 2nd respondent should be directed to conclude the enquiry in all respects and issue a speaking order on the same. As the enquiry is in progress and as the hearing is fixed on 25.09.2021, this Court is of the opinion that nothing further survives for a adjudication. The 2nd respondent is, therefore, directed to consider the reply given by the petitioner and complete the enquiry in all respects, as per the applicable rules and regulations, within a period of one month from the date of receipt of a copy of this order. It is needless to say that a speaking order must be passed and communicated to the petitioner. The said order must be passed on merits of the matter without being influenced by the fact that the High Court has passed this order.
