ORDER :

This writ petition is filed under Article 226 of the Constitution of India seeking the following relief:-

“….to issue a Writ Order or Direction more particularly one in the nature of Writ of Mandamus, declaring t he action of the 3rd Respondent in not processing the document for registration regarding properties i.e., land admeasuring 51.165 Sq. Yards in D.No.22-8-21, Municipal New Assessment No.1021087697 (Old Assessment No.20972 and 29877) in Town Sy. No.209, Block No.1, Old Municipal Ward No 11, Walmet Dada Street, Lalapet, Guntur City, Guntur District, Andhra Pradesh which are belonging to the Petitioners is illegal arbitrary and contrary to the Registration Act and consequently direct the 3rd respondent to receive the document to be submitted by the Petitioners in respect of above said property and pass such other order….”

Though the petitioners made several allegations against the respondents, during hearing, learned counsel for the petitioners requested this Court, without touching the merits of the case, to issue a direction to the respondents to receive and register the document of the petitioners.

Learned Government Pleader for Stamps and Registration readily agreed to receive and process the document of the petitioners, in accordance with law.

In view of the concession given by the learned Government Pleader for Stamps and Registration, respondents are directed to receive and process the document submitted by the petitioners, in accordance with law. In case the instrument presented can’t be registered, the Registrar shall pass reasoned order as mandated

under Section 71 of the Act as it is appealable under Section 72 of the Registration Act.

With the above direction, the Writ Petition is disposed of. No costs.

As a sequel miscellaneous application, pending, if any, shall
