ORDER:-

This writ petition is filed seeking direction to the respondents 2 to 4 to take action on the representation of the petitioner dated 01-07-2021 and to protect the constitutional right of the petitioner.

Heard learned counsel for the petitioner and learned Assistant Government Pleader for Home, appearing for respondents 1 to 4.

As can be seen from the alleged representation, dated 01.07.2021, which is available at page No.17 of the material papers, the contents of the same clearly disclose that the matter essentially pertains to a civil dispute relating to the land in question. It is evident from the said contents of the representation that the representatives of the 5^th respondent company i.e. Jaiprakash Power Venture Limited, approached the petitioner and assured him that they would pay money relating to the land and pipelines laid in said land and thereafter did not pay the said amount. So, stating that he would restore his agricultural operation in the said land, after removing the road that was laid in the said land and that he could not give any permission to run the vehicles through the said land on the road, the petitioner made the representation.

Therefore, as already noticed supra, the dispute is essentially of civil nature and the petitioner cannot now invoke the extraordinary jurisdiction of this Court under Article 226 of the Constitution of India to give a direction to the respondents 2 to 4 to consider the said representation and make an attempt to convert the civil litigation into litigation relating to public law remedy.

So, in the said facts and circumstances of the case, the writ petition lacks merit and this Court absolutely does not see any valid legal ground to admit the case for hearing.

Therefore, this Writ Petition is dismissed. There shall be no order as to costs.

Miscellaneous Petitions, if any pending, in this Writ Petition, shall stand closed.
