ORDER:

The petitioner claims to be the owner of property bearing D.No.6/154 and 155 situated in Vinayaka Nagar, Proddutur, YSR Kadapa District. He submits that on account of a dispute relating to ownership of the said property, the 1^st respondent temple had filed O.A.No.3 of 2018 against the petitioner herein before the Andhra Pradesh Endowment Tribunal, under Section 83 of the Hindu Religious and Charitable Endowments Act, 1987 (for short “the Act”). It is the further case of the petitioner that even though an application under Section 83 of the Act is pending before the Tribunal, the respondent authorities have been trying to disturb the possession of the petitioner by visiting the property regularly and coercing the petitioner to vacate the property.

The Executive Officer of the 1^st respondent has now filed a counter affidavit wherein it is stated that an application has been filed before the Andhra Pradesh Endowment Tribunal under Section 83 of the Act and the same is pending. He further submits that the claim of the petitioner that the respondent authorities are frequently visiting the property, which is in dispute and are trying to evict the petitioner, is false.

The statement of the Executive Officer of the 1^st respondent that they are not seeking to evict the petitioner except in accordance with the procedure established under

Section 83 of the Act is recorded and the writ petition is closed, leaving it open to the petitioner to approach this Court in the event of any further injury to his rights. There shall be no order as to costs.

As a sequel, pending miscellaneous petitions, if any, shall stand closed.
