ORDER:-
This Criminal Petition under Section 482 of the Code of Criminal Procedure, 1973 (for short “Cr.P.C.”) is filed seeking return of the vehicle that was seized in Crime No.455 of 2021 of Nandigama Police Station, Krishna District.
Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State.
Learned counsel for the petitioner would submit that this is a covered matter in view of the orders passed in Criminal Petition No.4429 of 2019, dated 26.07.2019, and Criminal Petition No.3441 of 2020, dated 31.08.2020, and Criminal Petition No.3924 of 2020, dated 26.11.2020, and thereby prayed to pass appropriate orders accordingly in this Criminal Petition also stating that the petitioner is also similarly placed.
Learned Additional Public Prosecutor for the respondent/State would submit that this is a covered matter in view of the aforesaid orders of this Court and thereby prayed to pass appropriate order in this petition also.
In view of the aforesaid earlier orders of this Court and for the reasons stated therein, the Criminal Petition is allowed and the Tata Infra Auto vehicle bearing registration No.AP 39

TG 6358 seized in the above crime, is ordered to be returned to the petitioner towards interim custody on execution of self bond for Rs.50,000/- (Rupees fifty thousand only) with two sureties for a likesum each to the satisfaction of the Station House Officer, Nandigama Police Station, Krishna District. The petitioner shall not make any alienation of the vehicle and he shall also not change the physical features or create any encumbrances or charge to the vehicle. He shall produce the vehicle as and when directed by the Court or the concerned officer, till the said case is disposed of according to law.
Miscellaneous petitions, if any pending, in the Criminal Petition, shall stand closed.
