ORDER :

This Criminal Petition under Section 482 Cr.P.C. is filed seeking return of the property that was seized from the possession of the petitioner in Crime No.90 of 2021 of Sangam Police Station, SPSR Nellore District, in a case registered for the offences punishable under Sections 272, 273, 328 of IPC and Sections 22, 23 r/w.5(1) of the Cigarettes and Other Tobacco Products (Prohibition of Advertisement and Regulation of Trade and Commerce, Production, Supply and Distribution) Act, 2003 (for short ‘COTP Act’).

Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the respondent State. 3) The petitioner is accused in Crime No.90 of 2021 of Sangam Police Station, SPSR Nellore District, registered for the aforesaid offences. On a petition filed by the petitioner under Section 482 Cr.P.C., the said F.I.R. registered against him was quashed by this Court in Crl.P.No.3006 of 2021 as per common order, dated 14.06.2021 passed by this Court. Therefore, as the crime registered against the petitioner was quashed, he has filed the present petition for return of the property that was seized from him.

Therefore, the Criminal Petition is allowed and the property that was seized from the possession of the petitioner in connection with the above crime is hereby ordered to be returned to the petitioner by the concerned Station House

The miscellaneous petitions pending, if any, shall also stand closed.
