ORDER:-
This Criminal Petition under Section 482 of the Code of Criminal Procedure, 1973 (for short “Cr.P.C.”) is filed seeking return of property that was seized from the possession of the petitioner in connection with Crime No.164 of 2021 of Vinukonda Town Police Station, Guntur District.
Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State.
The F.I.R registered against the petitioner in the above crime No. 164 of 2021 of Vinukonda Town Police Station was quashed by this Court on a petition filed by the petitioner under Section 482 Cr.P.C. The said fact is not disputed by the learned Additional Public Prosecutor. The same is also evident from the common order passed by this Court in Criminal Petition No.3255 of 2021 and batch. Therefore, as the crime registered against the petitioner was quashed, the petitioner is entitled for return of the property that was seized from his possession.
In the result, the Criminal Petition is allowed. The property that was seized from the possession of the petitioner in connection with the above crime is ordered to be returned to the petitioner on proper identification and acknowledgement.
Miscellaneous petitions, if any pending, in the Criminal Petition, shall stand closed.
