ORDER:-
Petitions in I.A.Nos.2 and 3 of 2021 seeking permission to compound the offence are filed in this criminal petition.
The main Criminal Petition No.3119 of 2021 has been filed seeking quash of charge sheet in C.C.No.16 of 2020 on the file of the learned IV Additional Judicial Magistrate of First Class, Tirupati, which was filed for the offence punishable under Section 506 r/w 34 IPC. It is a compoundable offence. Therefore, the petitioner can as well approach the trial Court and file a petition under Section 320 Cr.P.C to compound the offence.
Therefore, learned counsel for the petitioner sought permission to withdraw the petition with liberty to approach the trial Court and file petition under Section 320 Cr.P.C to compound the offence.
Permission is accorded.
Accordingly, the Criminal Petition is dismissed as withdrawn, granting liberty as prayed for.
Miscellaneous petitions, if any pending, in the Criminal Petition, shall stand closed.
