ORDER:
This Court, on 02.02.2021, while considering the submissions made by either side in W.P.No.2200 of 2021 had directed that the tender process in relation to supply of Milch animals should not be finalized till further orders. Subsequently, it was brought to the notice of this Court that the online message in the tender portal of the Government showed that the tender had been awarded to certain parties. As this would amount to violation of orders of this Court, suo-moto contempt had been initiated in the present case. After receiving notice, the contemnor has filed an affidavit and an additional affidavit.
- It is the case of the contemnor that the entire process is automated and there is no provision for manual intervention in the said process. He further submits that the tender process is a time bound process and upon the completion of the time provided, the system automatically generates certain responses including the response of “tender has been awarded to the lowest tenderer”. The contemnor on the basis of the above submissions submits that there was no manual intervention or any action done by the contemnor in violation of the orders of this Court.
