ORDER:-

This Writ Petition is filed under Article 226 of Constitution of India, to declare the action of the respondents 2 and 3 in not taking any action on the representation of the petitioners dated 13.10.2008 for conducting enquiry about the social status and for cancellation of S.T. caste certificate of the 5^th respondent, as illegal and arbitrary and consequently direct the respondents 2 and 3 to consider and dispose of the representation of the petitioners dated 13.10.2008 in accordance with law.

The main grievance of the petitioners is that though the petitioners made a representation on 13.10.2008 to the 2^nd respondent, no enquiry was conducted till date as to the social status and for cancellation of the S.T. caste certificate issued to the 5^th respondent. Since the inaction of the respondent amounts to failure to discharge public duty, the petitioner requested to issue a direction.

Learned Government Pleader for Social Welfare fairly conceded that the 2^nd respondent alone is competent to conduct enquiry and to take action for cancellation of certificate, if found illegal.

In view of the submission made by learned counsel for petitioners and learned Government Pleader, the 2^nd respondent is directed to dispose of the representation of the petitioners dated 13.10.2008 as expeditiously as possible in accordance with law

after affording opportunity liberty to the petitioners and 5^th respondent and in any event not latter than four (04) months from today.

With the above direction, the Writ Petition is disposed of. There shall be no order as to costs.

Miscellaneous petitions pending if any, in this Writ Petition,

shall stand closed.
