ORDER:
This Court, while issuing notice before admission, passed the conditional order on 02.03.2020, granting interim stay of all further proceedings pursuant to the auction notice dated 28.01.2020, on condition of the petitioner paying entire arrears of amount of Rs.31,409/- within a period of one (1) weeks from the date of receipt of a copy of the said order. But, the petitioner failed to comply with the said order till date.
When the matter was called on 19.08.2020, 26.08.2020 and 27.08.2020 for hearing, there was no representation for the petitioner, as such the matter was directed to be posted to 28.08.2020 under the caption ‘for dismissal’. On 28.08.2020, on behalf of learned counsel for the petitioner, another learned counsel appeared and stated that the grandmother of the learned counsel for the petitioner had been hospitalized. Hence, the matter was directed to be posted under the same caption on 11.09.2020. But, when the matter was listed on 02.11.2020 for hearing, there was no representation for the petitioner, as such the matter was directed to be posted today under the same caption. Even today also, there is no representation for the petitioner either in the morning or in the afternoon. From this, it appears that the petitioner is not interested either in complying with the conditional order or prosecuting the matter.

Hence, the Writ Petition is dismissed for non-prosecution. No
order as to costs. As sequel to it, Miscellaneous Petitions, if any pending, shall stand dismissed.
