THE HON’BLE SRI JUSTICE M.SATYANARAYANA MURTHY WRIT PETITION No.3150 OF 2020
ORDER :
This writ petition is filed under Article 226 of the
Constitution of India seeking the following relief:
“to issue a Writ of Mandamus, declaring the action of the Respondent No 1 and his staff taking the measurements of the Land of the Petitioners and making peg marks therein i e the Land of the Narinameraka Gram Panchayath/Respondent No 4 which is under the enjoyment of the Narinameraka villagers/Petitioners admeasuring Ac.3-30 cents in Sy.No.388-A (In Adangal 388-1A) situate at Narinameraka, Ilapakurru Revenue village, Elamanchili Mandal, West Godavari District and classified the Government Poramboke Land being used as Mandabayalu which is a communal Land of the Narinameraka villagers/Petitioners for user as threshing field and for pastoral practices etc without putting them on any notice violating the Principles of Natural Justice and the Constitutional spirit of Gram Panchayaths and the provisions of the A.P Panchayath Act 1994 and Rules made there under and it is further consequentially prayed that this Court may be pleased to direct the Respondents not to dispossess the Petitioners from any part of the said Land “
Learned counsel for the petitioners and the learned Government Pleader for Revenue submit that the issue involved in this petition is squarely covered by the order of this Court in W.P.No.1631 of 2020 dated 20.02.2020.
In view of the submission of the learned counsel for the petitioners and the learned Government Pleader Revenue, this writ petition also stands allowed of in terms of the said order. No costs.
Consequently, miscellaneous applications, pending if any, shall stand closed.
The Registry is directed to attach a copy of the order in W.P.No.1631 of 2020 dated 20.02.2020 to this order.
