ORDER:

This Writ Petition is filed seeking a Writ of Mandamus to declare the action of the 3^rd respondent, in seizing petitioners’ vehicles, as illegal and arbitrary. Consequently, a direction is sought to the respondents to release the seized vehicles.

Petitioner No.1 claims to be owner of Tractor and Trailer bearing Nos.AP 37 BR 1971 and AP 16 BG 9133; petitioner No.2 claims to be owner of Tractor bearing No.AP 37 CP 6831; petitioner No.3 claims to be owner of Trailer bearing No.AP 16 TJ 2633; and petitioner No.4 claims to be owner of Trailer bearing No.AB W 1468. Alleging illegal transportation of sand, the Tractors and Trailers were seized and registered an FIR.

Learned counsel for the petitioners, learned Government Pleader for Home as well as learned Government Pleader for Mines and Geology submit that the issue raised in this Writ Petition is squarely covered by an order of this Court in W.P.No.671 of 2020 dated 08.01.2020.

The present Writ Petition is, accordingly, disposed of in terms of the order in W.P.No.671 of 2020, dated 08.01.2020 directing the respondent - authorities to impose penalty in terms of Clause 16 of G.O.Ms.No.71 dated 04.09.2019 and, on payment of such penalty by the petitioners, respondent – authority/appropriate authority shall release the Tractor and Trailer bearing Nos.AP 31 AS 4935 and AP 31 TG 4147 of petitioner No.1, Tractor bearing No.AP 37 CP 6831 of petitioner No.2, Trailer bearing No.AP 16 TJ 2633 of petitioner No.3 and

Trailer bearing No.AB W 1468 of petitioner No.4 upon producing ownership documents of the said vehicles to their satisfaction. No order as to costs.

Miscellaneous petitions, if any, pending in this writ petition, shall stand closed.
