ORDER :

In this writ petition, the petitioner questions the validity of the notice, dated 26.06.2020, issued by respondent No.4 for collection of the rent on the ground that he is not competent to issue any such notice.

Heard learned counsel for the petitioner and learned Government Pleader for Home appearing for the respondents.

Learned counsel for the petitioner would submit that this is a covered matter and this Court has earlier in W.P.No.11795 of 2020 and batch, by its common order, dated 25.08.2020, set aside the similar notices issued by the concerned Police Officials of the Criminal Investigation Department (C.I.D.) on the ground that they are not competent to issue any such notices. Therefore, he would pray for passing of similar orders in this writ petition also.

Learned Government Pleader for Home appearing for the respondents also fairly conceded that this is a covered matter in view of the earlier orders passed by this Court in the above batch of writ petitions. Therefore, he prays to pass appropriate orders in this writ petition also.

A perusal of the common order, dated 25.08.2020, passed in W.P.No.11795 of 2020 and batch, makes it clear that this Court has set aside similar notices issued by the concerned Police Officials of C.I.D. on the ground that such officers are not competent to issue any such notices.

Therefore, in view of the aforesaid common order passed by this Court in W.P.No.11795 of 2020 and batch, and for the reasons stated

therein, this Writ Petition is allowed and the impugned notice, dated 26.06.2020, is set aside. No costs.

As a sequel, pending miscellaneous petitions, if any, shall stand closed.
