Learned counsel for the petitioner submits that admittedly the petitioner is an ex-serviceman and he was assigned an extent of Ac.5.00 cents in Sy.No.337/1B situated at Chindepalli Village, Yerpedu Mandal, Chittoor District with a condition not to alienate the land for a period of ten years. The petitioner was issued NOC as per G.O.Ms.No.1117, dated 11.11.1993 vide order of the then Tahsildar, dated 20.02.2012. Thereafter G.O.Ms.No.307, dated 06.06.2013, was issued and as per the said G.O, the 2nd respondent is the competent authority to issue NOC and the said G.O is only prospective and do not cover for the NOCs already granted by the authorities. Hence, the question of insisting for fresh NOC by the 5th respondent does not arise. In fact, in supersession of the G.O.Ms.No.307, the G.O.Ms.No.279, Revenue (Assn.I) Department, dated 04.07.2016, was issued stating that the procedure of issuing NOC is dispensed with and there is no need for obtaining NOC in all cases of assignments made to ex-servicemen and freedom fighters in which a period of ten years has expired. Therefore, the action of the 5th respondent, in insisting for fresh NOC as per G.O.Ms.No.307, dated 06.06.2013, without following the orders issued in G.O.Ms.No.279, dated 04.07.2016, and the refusal to entertain the sale deed for registration stating that the subject land is included in the prohibitory lands list, is arbitrary and illegal.
